Takedown Policy

Mitzpe LLC ("Mitzpe") respects the intellectual property rights of others and expects users of mitzpe.org to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), Title 17, United States Code, Section 512, Mitzpe has adopted the following procedure for responding to claims of copyright infringement.
This page covers two situations:

You believe content on mitzpe.org infringes a copyright you own or are authorized to represent. Use the Filing a DMCA Notice procedure below.

You posted content (such as a comment, a submission, or contributed material) that was removed in response to a DMCA notice, and you believe the removal was in error. Use the Filing a Counter-Notice procedure below.
For inquiries about reproducing or republishing Mitzpe's own published analysis — Israel Brief, Dossiers, Vantage, Watchwords, Mitzpe Press titles, and related content — see the Intellectual Property section of our Terms of Service or contact press@mitzpe.org. That is a permissions inquiry, not a DMCA matter.

Filing a DMCA Notice
If you believe that material accessible on or from mitzpe.org infringes your copyright, you may submit a written notice of infringement to our designated agent. To be effective under the DMCA, your notice must include all of the following:

A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner.

Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works is sufficient.

Identification of the material claimed to be infringing or the subject of infringing activity, with information reasonably sufficient to permit Mitzpe to locate the material — for example, the URL of the page on mitzpe.org where the material appears.

Information reasonably sufficient to permit Mitzpe to contact you, including your name, mailing address, telephone number, and email address.

A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Send your notice to press@mitzpe.org with the subject line "DMCA Notice."
Caution. Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material or activity is infringing may be liable for damages, including costs and attorneys' fees, incurred by Mitzpe or by the alleged infringer. Do not file a DMCA notice unless you have a good-faith basis to believe the use is infringing and unauthorized. Fair use, criticism, commentary, news reporting, teaching, scholarship, and research are protected by U.S. copyright law and are not infringement.
Mitzpe's Response
Upon receipt of a DMCA notice that substantially complies with the requirements above, Mitzpe will:

Remove or disable access to the material claimed to be infringing.

Notify the user who posted the material, if applicable, that the material has been removed.

Forward a copy of the notice to the user who posted the material, if applicable.
Mitzpe may, in its discretion, terminate the accounts of users who repeatedly post infringing material.
Filing a Counter-Notice
If material you posted was removed in response to a DMCA notice and you believe the removal was the result of mistake or misidentification, you may submit a written counter-notice to our designated agent. To be effective under the DMCA, your counter-notice must include all of the following:

Your physical or electronic signature.

Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.

A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification of the material.

Your name, mailing address, telephone number, and email address.

A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or, if your address is outside the United States, the Federal District Court for any judicial district in which Mitzpe may be found, and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.
Send your counter-notice to press@mitzpe.org with the subject line "DMCA Counter-Notice."
Upon receipt of a valid counter-notice, Mitzpe will forward it to the original complainant. If the complainant does not file an action seeking a court order against the user within ten (10) to fourteen (14) business days, the removed material may be restored.
Caution. Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material was removed or disabled by mistake or misidentification may be liable for damages. Do not file a counter-notice unless you have a good-faith basis to believe the removal was an error.
Repeat Infringer Policy
In appropriate circumstances, and in our sole discretion, Mitzpe will terminate the accounts of users who are determined to be repeat infringers. We may also restrict access to mitzpe.org by users who infringe the intellectual property rights of others, regardless of whether the infringement is repeated.
Modifications
Mitzpe may update this DMCA Notice and Takedown Policy from time to time. The "Last updated" date at the top of this page reflects the date of the most recent revision.
