Terms of Service

Acceptance of Terms

By accessing or using mitzpe.org, subscribing to any Mitzpe publication, purchasing products, or engaging Mitzpe services, you ("you" or "Subscriber") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

 

These Terms constitute a legally binding agreement between you and Mitzpe LLC ("Mitzpe," "we," "us," or "our"), a for-profit limited liability company organized in the United States.

Our Services

Mitzpe provides intelligence analysis, strategic advisory, and editorial products focused on Israeli security and related geopolitical matters. Our services include:

  • Free publications. Israel Brief daily assessments and Field Dossiers, published Sunday through Thursday at mitzpe.org. The Israel Brief Flash Brief is also available by email via Substack at israelbrief.com.

  • Paid subscription tiers. Member and Supporter subscriptions offering access to additional analytical products, as described on our Subscribe page.

  • Mitzpe Press. Books and monographs published under the Mitzpe Press imprint, available for purchase and included in the Supporter subscription tier.

  • Contracted services. Institutional Intelligence retainers, the Diaspora Security Practice (Perimeter), advisory engagements, speaking, courses, and events — each governed by separate engagement agreements.

Account Registration

To access subscription content on mitzpe.org, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Team subscriptions (Member Team tier) are licensed for up to ten (10) named users within a single organization. Sharing login credentials beyond the authorized number of seats is prohibited.

Subscriptions and Payment

Subscription tiers and pricing:

​

  • Free. Israel Brief daily assessments and Field Dossiers. No payment required.

  • Member. $100 per year. Access to all Closed Dossiers, Vantage (monthly strategic synthesis), Watchwords (weekly tactical briefings), and the full archive.

  • Member Team. $900 per year for up to ten (10) seats. Same access as Member, with institutional invoicing and purchase order support.

  • Supporter. $250 per year. Everything in Member, plus quarterly Q&A sessions with Uriel Zehavi, a direct email line to the editor, 48-hour early access to new Dossiers, and one Mitzpe Press book per year mailed to your address. Supporter identities are held in confidence; Mitzpe does not maintain a public list of Supporters.

 

Billing and renewal. Paid subscriptions are billed annually in advance. Subscriptions renew automatically at the end of each billing cycle unless canceled before the renewal date. Payment is processed through Wix Payments and Stripe. By subscribing, you authorize us to charge the payment method on file for the applicable subscription fee at each renewal.

 

Price changes. We reserve the right to change subscription pricing. Any price changes will take effect at the start of your next billing cycle, and we will notify you in advance. Your continued subscription after a price change constitutes acceptance of the new pricing.

 

Team subscriptions. For Member Team subscriptions, institutional invoicing and purchase order support are available.

Refunds and Cancellations

Cancellation. You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you retain access to paid content through the remainder of the period you have already paid for.

Refunds. If you cancel within fourteen (14) days of your initial subscription purchase or annual renewal and have not substantially accessed paid content, you may request a full refund by emailing subscribe@mitzpe.org. After fourteen days, subscription fees are non-refundable. Partial-year refunds are not available.

​

Mitzpe-initiated cancellation. We reserve the right to terminate or suspend your subscription for violation of these Terms. In the event of termination for cause, no refund will be issued.

Mitzpe Press Book Sales

Mitzpe Press publishes books and monographs. These products may be purchased through third-party retailers, including Amazon. Purchases made through third-party retailers are subject to that retailer's terms of sale, return policy, and fulfillment process.

 

Supporter annual book. Supporters receive one Mitzpe Press title per year, mailed to the address provided. Mitzpe ships to domestic (United States) addresses at no additional cost. International shipping availability and any associated costs will be communicated at the time of address collection. If a Supporter does not provide a mailing address, the book benefit is forfeited for that year and does not carry over.

Contracted Services

Mitzpe offers contracted services including Institutional Intelligence retainers, the Diaspora Security Practice (Perimeter), the Nonprofit Advisory (for Jewish and Israel-supporting nonprofits), speaking engagements, courses, and events. These services are governed by separate engagement agreements negotiated and executed between Mitzpe and the contracting party.

These Terms of Service do not govern the specific deliverables, scope, pricing, or obligations of contracted services. In the event of a conflict between these Terms and a signed engagement agreement, the engagement agreement controls.

Intellectual Property

All content published by Mitzpe — including but not limited to Israel Brief assessments, Dossiers, Vantage issues, Watchwords briefings, Perimeter reports, Mitzpe Press books, and all text, analysis, graphics, and design elements on mitzpe.org — is the intellectual property of Mitzpe LLC and is protected by United States and international copyright law.

Citation. You may cite or quote brief excerpts of Mitzpe's published analysis for the purposes of commentary, criticism, news reporting, education, or research, provided that:

  • The excerpt is attributed to Mitzpe and, where applicable, to the specific publication (e.g., "Israel Brief, Mitzpe Institute").

  • The excerpt does not constitute a substantial reproduction of the original work.

  • A link to the original publication on mitzpe.org is included where practicable.

 

Reproduction and redistribution. Reproduction, redistribution, or republication of Mitzpe content — in whole or in substantial part — requires prior written permission from Mitzpe. This includes forwarding paid-tier content (Closed Dossiers, Vantage, Watchwords) to non-subscribers, reposting articles in full on other platforms, and compiling Mitzpe content into derivative works.

Mitzpe Press. Books published under the Mitzpe Press imprint are subject to the copyright terms specified in each publication. All rights are reserved unless otherwise stated.

Permitted and Prohibited Use

Permitted Uses:

  • Reading and accessing Mitzpe content in accordance with your subscription tier.

  • Citing excerpts with proper attribution as described in the Intellectual Property section.

  • Sharing links to publicly available content on mitzpe.org.

  • Using Mitzpe analysis to inform your own decision-making, research, writing, and professional work.

Prohibited Uses:

  • Sharing, forwarding, or distributing paid-tier content to individuals who do not hold an active paid subscription, except as brief attributed excerpts.

  • Systematically downloading, scraping, or harvesting content from mitzpe.org by automated means.

  • Removing, altering, or obscuring copyright notices, author attribution, or other proprietary markings.

  • Using Mitzpe content to train machine learning models, large language models, or similar artificial intelligence systems without prior written permission.

  • Misrepresenting Mitzpe's analysis, attributing fabricated statements to Mitzpe or its analysts, or presenting Mitzpe content as your own original work.

  • Using Mitzpe content in any manner that is unlawful, defamatory, or that infringes on the rights of any third party.

  • Circumventing or attempting to circumvent access controls, paywalls, or authentication mechanisms on mitzpe.org.

 

Mitzpe reserves the right to suspend or terminate the account of any user who violates these provisions.

User Conduct

You agree not to use mitzpe.org or any Mitzpe service to:

​

  • Engage in any activity that violates applicable local, national, or international law.

  • Transmit viruses, malware, or other harmful code.

  • Attempt to gain unauthorized access to any part of mitzpe.org, its servers, or any systems connected to the site.

  • Interfere with or disrupt the operation of mitzpe.org or any other user's experience.

Disclaimers

Mitzpe's publications and services provide analysis and intelligence assessments. They do not constitute legal, financial, investment, military, or security advice. Mitzpe's analysis reflects the professional judgment of its analysts based on available information and is subject to revision as new information emerges.

Estimative language. Mitzpe publications use calibrated probability language (e.g., "likely," "unlikely," "almost certainly") in accordance with established intelligence-community methodology. These assessments are probabilistic judgments, not guarantees of outcomes.

​

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. MITZPE DOES NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MITZPE LLC, ITS FOUNDERS, ANALYSTS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE OUR SERVICES, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.

IN NO EVENT SHALL MITZPE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES EXCEED THE AMOUNT YOU PAID TO MITZPE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless Mitzpe LLC, its founders, analysts, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your misuse of Mitzpe content, or your infringement of any third party's rights.

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of South Carolina, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or your use of our services shall first be submitted to good-faith negotiation between the parties. If the dispute is not resolved within thirty (30) days, either party may pursue resolution through binding arbitration administered in accordance with the rules of the American Arbitration Association, conducted in English, with the seat of arbitration in South Carolina.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property rights or to prevent irreparable harm.

Modifications to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where practicable, notify active subscribers by email. Continued use of our services after changes are posted constitutes your acceptance of the updated Terms.

If you do not agree with the revised Terms, you may cancel your subscription and discontinue use of our services.

Termination

We may suspend or terminate your account and access to our services at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is otherwise objectionable.

Upon termination, your right to access paid content ceases immediately. Provisions of these Terms that by their nature should survive termination — including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law — shall survive.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
